Request Property Information
Any person can request building information relating to a specific property under Regulation 51 of the Building Regulations 2018. Please note that Building Property Information certificates are charged per regulatory matter 51 (1), (2) & (3) and per title of land as each individual parcel of land must be searched.
51(1) Any person can request details on any building permits obtained for a property in the preceding 10 years. This
information includes building and occupancy permits, final certificate details. details of any current determination made under regulation 64(1) (Combined Allotment Statement – to treat Two or more allotments as one) or exemption granted under regulation 231(2) and any outstanding building notices or orders made under the Building Act 1993.
51(2) Requests can be made to obtain specific details affecting a property. This information is required when obtaining a building permit for new building works. Responses will include details as to whether or not the building or land is in an area:
- in an area that is liable to flooding within the meaning of regulation 5(2) ; or
- in an area that is designated under regulation 150 as an area in which buildings are likely to be subject to attack by termites; or
- in an area for which a bushfire attack level has been specified in a planning scheme; or
- is an area designated under regulation 152 as likely to be subject to significant snowfalls; or
- designated land; or
- designated works.
PLEASE NOTE that (e) Designated Land (Reg 154) and (f) Designated works (Reg 154) within the Reg 51 (2) response are intentionally left blank on the 51 (2) certificates as the Mildura Rural City Council does not have the adequate maps or systems to respond.
51(3)An owner, mortgagee or prescribed building practitioner under Section 137B (owner builder report) of the Building Act 1993 can request inspection approval dates of the mandatory notification stages for building work carried out on that building or land. (Not all inspection approval dates may be available).
