Implementation of Deakin Avenue Urban Design Guidelines
Current Status
Mildura Planning Scheme Amendment C95 - Deakin Avenue Urban Design Guidelines - was approved by the Minister for Planning via DELWP Department of Environment Land Water and Planning as Published in the Victorian Government Gazette on 9 May 2019.
Background/Introduction
Amendment C95 to the Mildura Planning Scheme implements the findings of the Deakin Avenue Urban Design Guidelines Final Report August 2016 and one element from the Mildura Planning Scheme Review 2014 into the Mildura Planning Scheme.
Amendment C95 applies to all lots with frontage onto Deakin Avenue, Mildura located between Seventh Street and the Sturt Highway.
The Amendment is required to implement the key objectives and design guidelines identified in the Deakin Avenue Urban Design Guidelines. The amendment proposes to make minor amendments to the Municipal Strategic Statement as well as existing overlay schedules.
The Amendment will delete the existing Schedule 1 to the Design and Development Overlay DDO1 and will apply a new set of DDO schedules along the length of Deakin Avenue, including sufficient direction for the section in the Mildura CBD. It is therefore deemed necessary that Design and Development Overlay, Schedule 3 cease from applying to land fronting Deakin Avenue to avoid overlap and repetition in controls. Additionally, The Mildura Planning Scheme Review 2014 recommended capping of floor area for lots fronting Deakin Avenue which will ensure that retail activity and development is not drawn away from core retail areas, whilst still allowing for fine grain and smaller format retail land uses. The amendment therefore seeks to modify the existing schedule of the C1Z to insert an 80sqm maximum floor space requirement for lots fronting Deakin Avenue.
